Where is it legally?

He yells “HEY”, I turn around and he bends over me… bad decisions are made every day. As you can see in this video I was scared for my life and simply defending myself from the evil in this world as he leaned towards me.

Now the injured party intervenes. MMA Fighting obtained a police report identifying the alleged victim as 31-year-old Justin Balboa, a busboy at an outback steakhouse restaurant. Schilling is now threatened with an administrative offense report because of a simple battery.

In Balboa’s conversation with police officers, he described Schilling as a “6ft 5, 270lb white man who just hit him for no reason”. But police say Balboa “would not elaborate on how or why the man hit him.”

The bar manager gave police a different side of the story, saying Balboa was “extremely drunk and may have made an inappropriate comment about the girlfriend/wife of the man who hit him, which caused the fight to escalate”.

The manager also described Balboa as a “regular who routinely causes trouble at the facility due to his state of intoxication.” According to the police report, “numerous other guests at the home corroborated the manager’s story,” stating that it was Balboa who started the incident.

After seeing the video, Balboa later told officers he now plans to file a complaint against Schilling over the alleged assault. Attorney Robert Solomon released this statement to MMA Fighting:
