But that doesn’t mean Mr Lewin has a clear path to another guilty verdict. Mr. Lewin and his colleagues will still have to contend with hazy memories, some of which are 40 years old; the lack of a gun in Ms. Berman’s shooting; and the lack of a body or even a crime scene in the disappearance and presumed death of Ms. Durst, for which no one has ever been charged.
Mr. Durst, 75, frail and worth $100 million, has repeatedly said he did not kill his first wife, nor does he know who killed Ms. Berman. And despite the certainty of a trial, Dick DeGuerin, the Texas attorney leading Mr. Durst’s defense team, insists prosecutors still haven’t proven Mr. Durst killed either woman.
As for the hard-line prosecutor, who he has repeatedly clashed with, “He’s a bully, but that’s not uncommon for prosecutors,” Mr. DeGuerin said of Mr. Lewin. “And he’s not used to people standing up to him.”
Both sides have already invested an enormous amount of time and money in the case. Mr Durst’s defense is expected to cost well over $10 million, according to two people who were briefed on the matter and asked not to be known because they were not authorized to discuss it publicly.
Mr. Lewin, 54, looks like an out of shape football lineman with a modified crew cut. He’s telling jokes at his own expense one minute and ranting about the defense the next. But he’s always on the case.
“I’m like the sloth,” he told Los Angeles Magazine, referring to the mammal that spends most of its time hanging upside down in trees. “I have this one ability.”

A Southern California prosecutor who has indicted the likes of notorious New York real estate heir Robert Durst said he feared for his life after a man he sent to prison for the 1988 murder of his estranged wife was on parole should be released.
“I was absolutely shocked,” said John Lewin, L.A. County’s assistant district attorney.
The California Department of Justice said William T. Bradford was “granted paroleable” last week after a commissioner ruled Bradford posed no threat to society.
Lewin is best known for his work on the Durst murder case, which was featured on the HBO documentary The Jinx.
Durst is awaiting trial in LA. He is accused of killing his ex-girlfriend Susan Berman in Benedict Canyon 18 years ago.
Lewin has spent decades prosecuting complicated circuitous murder cases like this one – and he says he’s stunned that a California parole officer recommended that one of the people Lewin helped get him sent to prison for life be released now should.
Bradford was convicted of the 2002 murder of Joan Bradford Lockwood. He is now 84 years old and has shown some signs of dementia.
“…And just to be sure, when she was down and probably dead, he shot her twice more,” Lewin said, recalling the case.
She was killed when the couple finalized their divorce, and Bradford would have to pay her about $40,000. Two of the couple’s children found the body.
Bradford was sentenced to 26 years to life in prison, but Lewin says it’s what happened after the trial that worries him.
“His cellmate came forward and said he intended not only to murder me, but to first murder my family in front of me and then shoot me,” Lewin said.
The parole officer’s recommendation will be reviewed by Gov. Jerry Brown later this year, and Lewin hopes the governor will step in.
“This man is still a significant danger, not just to me and my family, but to anyone he harbors bitter feelings for,” Lewin said.
The governor could reverse the recommendation or order another review. If Brown doesn’t act, the decision stands and Bradford could be sacked early next year.
Bradford was eligible for a parole hearing after serving about 16 years due to more relaxed criminal laws in place at the time of the murder in 1988.

With Durst in custody (as of March 2015), prosecutors were finally able to approach his friends and associates without fear of startling the accused. Nick Chavin, Lewin tells the jury, was “top of the list.” According to Lewin, when Chavin and Balian called on April 6, 2015, he was adamant and “reluctant to provide any information about his close friend.” Undaunted, Lewin patiently began picking at Chavin’s conflicting loyalties and playing on his guilty conscience. It’s about what Durst said to Chavin outside a Harlem restaurant in December 2014 about Susan Berman’s death. In the recorded phone calls, Chavin is initially vague, telling Lewin and Balian that Durst was noncommittal, “shrugging and muttering something.” In a subsequent phone call, Chavin tells investigators that he “wants to take it back.” Playing back excerpts of the recorded conversations for the judges, Lewin demonstrates that he and Habib Balian tag-teamed Chavin for months, years, nudging him and empathizing and nudging more, shaping a reluctant witness into a more cooperative one.
Chavin’s transformation coincides step-by-step with Lewin’s gradual rise as an actor with an important speaking role – moral, empathetic, unrelenting. “We are all responsible for the decisions we make,” Lewin Chavin reminds us over the phone. “You’ve been waiting for this call from us… It’s like taking a band-aid off.” Haunted, cornered, embarrassed, even Chavin can’t help but appreciate Lewin’s psychological insight. “It’s like knowing what’s going on in my head,” he marvels. Lewin and Balian date until February 16, 2017, when Chavin finally tears the band-aid off and reveals all the details of his conversation in Harlem with Robert Durst.
NICK CHAVIN: WE WENT OUT THE DOOR – THIS IS HARD. WE WENT OUT THE DOOR AND ON THE SIDEWALK I SAID YOU WANTED TO TALK ABOUT SUSAN AND BOB SAID I HAVE TO. IT WAS YOU OR ME. I HAD NO CHOICE.”

Lewin’s questioning of Emily Altman is far less sensitive. Emily Altman was called to Los Angeles to testify in July 2017 and was accompanied by two private attorneys. However, they offered her a little cover during her grueling three days on the witness stand. In Altman’s videotaped testimony (parts of which were shown during the opening), Lewin is adamant, alternating between disbelief and sarcasm as he taps into her guarded response to the ongoing disappearance of Kathie Durst and later to the murder of Susan Berman.
LEWIN: LET ME ASK YOU THAT. I WOULD ASSUME IF YOU TALK TO BOB, RIGHT, AND YOU HAVE NOT TALKED TO HIM FOR A TIME, I RIGHT, THAT A QUESTION THAT COULD COME AT THE TOP OF THE LIST WOULD BE: “HEY, BOB, HAS ANYONE BY BELONGS TO YOUR MISSING WIFE?”
ALTMAN: I WOULD SAY, “HAS ANYONE HEARD ABOUT KATHY?”
LEWIN: RIGHT. BUT THAT WOULD BE AN ISSUE YOU WOULD THINK, RIGHT?
ALTMAN: POSSIBLY, YES.
