T-Wolves Shareholder Meyer Orbach Alleges A-Rod Sale Violates Partnership Agreement

Gene Sweeney Jr.

The ownership saga of the Minnesota Timberwolves and Minnesota Lynx took a different turn.

According to ESPN’s Adrian Wojnarowski, Meyer Orbach has filed a lawsuit in US District Court in Minneapolis over the sale of Glen Taylor’s Timberwolves to a group led by Marc Lore and Alex Rodriguez. Orbach claims the upcoming sale violates the franchise’s partnership agreement.

Most notably, the complaint said the deal did not include a provision committing Lore and Rodriguez to keeping the Timberwolves in Minnesota, according to Wojnarowski.

According to the complaint, the purchase agreement requires the owners to submit a possible relocation decision to the advisory board, but the board’s approval would not be required for such a relocation.

Taylor signed a lease with the City of Minneapolis in 2016 to keep the Timberwolves at Target Center during the 2034-35 season. However, the team’s ownership group would only have to pay $50 million to lockdown Minneapolis beforehand.

That probably wouldn’t be a problem for Lore and Rodriguez after they reached an agreement to buy the Timberwolves and Lynx for $1.5 billion. The Athletic’s Jon Krawczynski initially reported they had entered a 30-day negotiation window to get things settled. The plan calls for Taylor to remain part of the ownership group for two and a half years, after which he would relinquish control.

The complaint also alleges that Taylor failed to honor the minority shareholders’ “trailer rights,” which would allow them to sell their interests in the franchise before the majority owner’s sale was complete.

Any time ownership of a sports franchise changes hands, relocation is often one of the biggest concerns for the fanbase, especially when the team plays in a smaller market.

For example, the writing for the Seattle Supersonics seemed to be on the wall from the moment they were purchased by a group of Oklahoma City businessmen in 2006. The Oklahoma City Thunder were born in time for the 2008-09 season.

Neither Lore nor Rodriguez have deep ties to the Twin Cities, so Wolves fans would inevitably be worried about the team’s future.

Taylor tried to allay those fears when he said in April that “the NBA will not condone the Timberwolves’ move from here to Seattle.” He added the league would prefer to expand rather than have a team move to the Pacific Northwest.

The 80-year-old was more definitive with the Star Tribune’s Chris Hine in April.

“They will keep the team here, yes,” he said. “We’re going to put it in the agreement. At that point we have a letter of intent, but when we do the deal we’re going to put that there. That’s not a problem. That won’t be a problem.”

Orbach’s complaint could show whether Taylor kept his word.

For a franchise that’s seen incredible ups and downs, this offseason has been unique, and that includes the news that Taylor, who also owns the Star Tribune, is seriously considering selling the team. Rosas said he has no doubts Taylor will find the right buyer. “To be fair, you have to understand Glen’s tenure and the stage he is in in his personal and family life,” Rosas said. “We all know this is part of the business. Glen has been amazing to me, my family and this organization during his time as owner. But it is not realistic to think that he will be the owner forever. He was very great, very supportive, very transparent in this process. I was aware of that and I knew this was something he was working on. I know he is doing everything he can to ensure this organization moves forward and that we have the right ownership and resources to move forward successfully.”
