Baden testified at the O.J. Simpson trial on August 10-11, 1995, making two allegations that he later denied. First, he claimed that Nicole Brown was still standing and conscious when her throat was cut.[30] The purpose of this claim was to dispute the theory that Brown was the intended target. Prosecutors argued that Brown was murdered first and was the intended target because there was no blood on the soles of her feet despite the large amount of blood at the scene and that she was unconscious when her throat was cut because she had very few defensive wounds.[ 31][32] At the ensuing civil trial the following year, he denied that allegation, admitting that it was absurd to think that anyone would stand still without moving their feet while their throat was cut and not fight back.[33] [34][35]

Baden then claimed that Ron Goldman remained conscious[36] and struggled with his attacker for at least ten minutes[37] with a severed carotid artery.[29][28] The purpose of this testimony was to extend the timeline to the point where Simpson had an alibi.[38] In the subsequent civil trial, he initially denied this allegation, and after being confronted with a video clip in which he said this in the criminal trial, he dismissed it. Baden claimed he misunderstood the question, but Goldman’s attorney claims he said it because the defense paid him to do it. He also claimed that Baden knowingly made false statements because he knew Ron Goldman’s blood was found in Simpson’s Bronco, even though Goldman never had the opportunity to be in Simpson’s car while he was alive.

After the trial, Baden said testifying for Simpson was a mistake as his reputation and credibility never recovered and his clientele for his consulting practice had all but disappeared. Due to the negative public reaction to the acquittal,[42] the jury indicated that they believed both of his above claims, which he later denied,[43] and the trial was televised, making his testimony widely known[ 4] he was constantly made to rehash his testimony from the Simpson case during cross-examination in other cases, and was constantly discredited for allegedly being a “hired expert” who sold himself to Simpson and made intentionally misleading testimonies to collect an advance of $165,000. 10]
