14 Jan 2022 13.01 As previously mentioned, Australian public law expert Associate Professor Janina Boughey believes Djokovic’s appeal will fail due to the minister’s discretionary powers in the absence of procedural errors.
In a video posted online by the University of New South Wales, Boughey explains that there are now fewer appeals for Djokovic: Under the section giving the minister personal discretion, there are fewer appeals, leaving Mr Djokovic unable to appeal to the Administrative Court. He could only apply for a judicial review. And the courts, conducting judicial review, determine whether the power was lawfully exercised. So it would all depend on how the minister wields power and whether he does so in a legitimate manner.
The discretion that the minister has is very wide, so realistic, unless the minister makes a procedural error, doesn’t comply with the provisions of the law or unless the decision is…really unfounded…then Mr Djokovic is unlikely to succeed .

But again, if the minister has the power to do as he pleases, then Djokovic’s appeal will surely fail. It certainly felt like Djokovic’s legal team was grasping at a lot of straws at this hearing, but it was enough to put the judge at a disadvantage and visibly annoy him as things were unfolding. Wood says Immigration Secretary Alex Hawke’s rationale is in “crass contrast” to that used by the Australian Border Force delegate. He says: The delegate said Mr Djokovic could infect other people because he wasn’t vaccinated. The current set of reasons is completely different. The Minister is assuming in Mr Djokovic’s favor every single fact that may have been questioned before, that he is complying with the law, that he poses only a negligible risk to others, that Mr Djokovic has a medical reason not to vaccinate to let, and that Mr Djokovic is of good standing. Wood says the central thrust of the case is that Hawke made a “binary” decision: that Djokovic could stay in Melbourne, leading to potential “excitement” in the anti-vax community; against the forcible removal of a man of good standing who has a medical contraindication. There is a bit of housekeeping about how the court can get the facts before it when no original motion has been made. Kelly makes a number of observations: In cases of urgency, if necessary, a party may make a request prior to the formal proceedings that initiate the court proceeding. The court may be prepared to accept an obligation on the parties to file and serve an affidavit containing essential documents as soon as possible. Kelly outlines the documents he has: Immigration Secretary Alex Hawke’s decision to annul Djokovic’s visa; and a government bill. Novak Djokovic has reportedly fired his two lawyers during his court battle against the visa annulment. The Serbian tennis player is now preparing to continue fighting through the courts to remain in Australia. The case of the world No. 1 is scheduled to be brought before a judge later today, who will decide his fate in relation to his stay in the country.
Earlier, Djokovic had traveled to Australia hoping to obtain a Therapeutic Use Exemption to enter the country without being vaccinated against COVID-19. However, the 20-time Grand Slam winner was at the end of a heavy blow when he was arrested by border officials with visa issues. Later, the Serbian star’s two lawyers, Natalie Bannister and Penelope Ford of Hall & Willcox, sought an injunction in the matter.
However, the documents provided by the lawyers contained a glaring error as they had misspelled the world champion’s name. Djokovic arrived in Australia on Wednesday and was immediately taken to an immigration hotel after being grilled for hours by the Australian Border Force over visa irregularities. Djokovic was granted a Therapeutic Use Exemption by Tennis Australia and the Victoria state government to allow him to attend the Australian Open unvaccinated. The document, which is a letter sent by Tennis Australia to the Association of Tennis Professionals and accessed by the Herald Sun, shows players were incorrectly informed they would be allowed to enter Australia if they can prove they had the virus after July .
Court documents released on Friday also show that Djokovic’s lawyers claimed in court that the tennis player was granted a TUE because of his recent COVID-19 illness. Djokovic’s lawyers claimed that he tested positive for COVID-19 on December 16 and was granted the special permit based on that. Djokovic’s case is due to be heard on Monday and a verdict is expected on the same day.
