ASHEVILLE — An Arden man accused of repeatedly shooting dead his neighbors during a dispute last year has pleaded guilty to two counts of second-degree murder, Assistant District Attorney Chris Hess said on Wednesday.

Erwin Lynn Jarvis, 60, was sentenced to 32 to 40 years in prison by Buncombe County Superior Court this week in the deaths of Robert and Genise Matheson.

The shooting took place on September 30, 2013, although tensions between the Birch Lane neighbors had been smoldering for some time. Jarvis said he “freaked out,” Hess said.

“He was sick of the behavior towards him and his family and just couldn’t take it anymore,” Hess said.

Jarvis and his wife said they were afraid of the Mathesons’ dog, a husky, and Jarvis carried a gun because of the dog, Hess said.

“These people just didn’t get along,” Hess said.

Jarvis was walking his dogs last September when he and Genise Matheson got into a confrontation, Hess said. Jarvis told a psychiatrist that she yelled and yelled at him and called him a coward, Hess said.

Jarvis pulled out a 9mm and emptied a clip onto the Mathesons, Hess said. The gun jammed while he was using the second clip, Hess said.

Police searched Jarvis’ home after the shooting and confiscated eight firearms, according to a search warrant. According to police records, city officials have been called to either house more than two dozen times over the past three years. Nine calls for loud music, six for rioting, two for screaming and one for trespassing.

Jarvis had no criminal record.
