MEMPHIS, Tennessee – A state investigation by the Tennessee Department of Commerce and Insurance is now focusing on a funeral home in Memphis, which is also the focus of a Netflix reality show.

Buried by the Bernards is a comedic glimpse into everyday life at R. Bernard Funeral Services in Orange Mound.

But the investigation is no laughing matter, especially for the family involved.

For years, Alfred Velasquez’s mother, Anita, lived with him while he was undergoing dialysis. Earlier this year, her body gave out.

“She died in hospice of kidney failure,” he said.

Velasquez said he called R. Bernard Funeral Services because the hospice provider recommended them. He hired her to cremate his mother. Her last wish was to scatter her ashes over the ocean. A few months later, the family went to Florida to spread their ashes, but they were shocked by what they found in the urn.

“We noticed another person’s information in the ash sack,” Velasquez said.

They saw a piece of paper with another woman’s name on it. They decided not to distribute the ashes and called the funeral home instead.

“They asked for the disc number on the ash. It was 450. They say it’s my mother. At this point, we don’t believe them because it’s someone else’s information,” he said.

When they returned, they filed a complaint with the Tennessee Board of Funeral Directors.

In R. Bernard’s written response to the state, they accused a mix-up of papers and alleged that they accidentally put someone else’s tag in Velasquez’s urn.

WREG went to the funeral home to get a response to the complaint, but management didn’t answer our questions on Monday and instead referred us to their attorney.

“We understand why they’re upset, but the fact of the matter is we can assure them they have the right ashes,” said attorney Randy Fishman.

But Velasquez said an apology from her attorney wasn’t enough. He wanted proof.

“I feel like it happens to other people because the other family I speak to, Luz Acevedo’s daughters, they have two cremation dates as she was due to be cremated a month after my mother. Nothing goes together,” he said.

He hopes to meet with R. Bernard’s management so they can prove what they think happened.
