Social media investigators claim to have uncovered the name of the man, who appears to be being protected by local police, who claim they are powerless to get him to stop playing the racist footage, which likely targeted the entire neighborhood and not only disturb the house of the Black family who lives next door.
According to a growing body of reports on social media, John Michael Eskildsen is the name of the man accused of setting up multiple surveillance cameras along with motion sensors to automate the playing of music that contained racist, anti-Black slurs and recorded monkeys contains sounds that run on a continuous loop whenever Jannique Martinez and her family enter or leave their home.
“Whenever we stepped out of our house, the monkey noises would start,” Martinez told local news outlet WAVY, which broke the news last week. “And it’s so racist and it’s disgusting.”
According to a tweet, Eskildsen is 47 years old and has lived at the address in question for about 25 years. A range of media outlets have also identified Martinez’s racist neighbor as Eskildsen. Another tweet suggested: “How about Tweeters in Virginia Beach pay this guy a (non-violent) visit? Maybe play some audio in front of HIS house??”

However, a quick review of a Virginia Beach noise ordinance found that “excessive noise poses a serious threat to public health, welfare, peace and safety, and quality of life,” and suggests that the actions of Martinez’s neighbors constitute an explicit Violation of the noise protection ordinance of the city. The only “exceptions” to this ordinance are emergencies or community-approved cases.
In particular, “no person shall allow, operate or cause a sound source to produce a sound level that can be heard in another person’s home during the hours between 10 p.m. and 10 p.m. and 7:00 a.m. above 55 dBA measured inside the dwelling at least four (4) feet from the wall nearest the source with the doors and windows to the reception area closed.”
Martinez and her family moved into their home five years ago and have consulted an attorney while evaluating their legal options, all of which have reached an impasse.
“By the law, it’s just a statement or sentence or he doesn’t do enough or physical harm or threats to my family,” Martinez said. “Why does it have to go this far before anything can be done? People shouldn’t have to live like this. I spent 11 years in the military. My husband is also in the military. We fought for this country, but there is no one fighting for us.”

Police said, “As appalling and offensive as the behavior of the neighbors is, the Virginia City Attorney and judges have separately determined that the acts reported to date have not risen to a level that Virginia law defines as criminal conduct.”
