The family of a Missouri teenager who died last month after sliding off a ride at an amusement park in Orlando, Fla., filed a wrongful death lawsuit Monday.

Tire Sampson, 14, died March 24 after falling from the Free Fall attraction at ICON Park.

His father and mother, Yarnell Sampson and Nekia Dodd, are named as plaintiffs in the 65-page lawsuit filed in Orange County’s 9th Judicial Circuit Court.

Orlando Eagle Drop Slingshot LLC, which owns Free Fall, and ICON Park were named as defendants. A representative from ICON Park was not immediately available Monday.

Also named as defendants are Funtime Handels GMBH and Gerstlauer Amusement Rides GMBH, an Austrian company that designed and manufactured the ride, NBC News affiliate WESH reported. No representative from the organization could be reached for comment.

Lawyers for the Slingshot group released a statement Monday that didn’t directly address the lawsuit but said the company was working with state investigators.

“We reiterate that all protocols, procedures and safety measures provided by the ride manufacturer have been followed,” the statement said. “We look forward to working with the Florida Legislature to implement changes in the industry, and we also support . . the ‘Tyre-Sampson Bill’ to prevent a tragic accident like this from ever happening again.”

The suit said the teenager’s life had been unnecessarily cut short.

“Tyre was… an honor student and football player. Despite his skills on the football field, he was known as a kind-hearted person who cared about others. Tire had a long and prosperous life ahead of him, which was cut short by this tragic event.

Attorney Ben Crump, representing Tire’s father in the lawsuit, said in a statement Monday the ride and seat maker failed to properly implement safety features. Tire fell at least 30 meters onto hard asphalt after being thrown out of the way, the statement said.

“The defendants in the Tire case have shown negligence in a variety of ways,” Crump said. “One of the most glaring examples was the lack of a $22 seat belt on a ride that cost millions of dollars to build.”

“From the ride and seat manufacturers, to the installer, to the owners and operators, the defendants had more than ample opportunities to provide safety precautions, such as seat belts, that could have prevented Tire’s death. They didn’t, and their poor decisions ended in fatal consequences for a promising young man and lifelong pain for his family,” Crump said in the statement.

Nikki Fried, commissioner of the state Department of Agriculture and Consumer Services, revealed during a media briefing on April 18 that “mismatches” by operators contributed to Tire’s death.

“Manual adjustments were made to the sensor for the seat in question that allowed the opening of the belt to the restraint to be almost twice the normal opening range of the restraint,” Fried said.

“These misadjustments resulted in the safety lights illuminating and not satisfying the ride’s electronic safety mechanisms sufficiently to allow the ride to operate even though Mr. Sampson was not properly secured in the seat,” she said.

Determining whether operator error was a factor is only the initial phase of the investigation, Fried said, noting that there are many other factors that may have contributed. The investigation is ongoing, she said.

A field report from Quest Engineering and Failure Analysis Inc. in Tallahassee says tires slipped through a gap between the seat and a shoulder harness that lowers over the riders’ torsos.

According to the report, there were no mechanical failures; Instead, evidence showed screws had been tightened and then loosened and sensors on his seat had been moved. The engineering firm also found that 27 of the 30 seats in the ride had an average restraint opening of 3.33 inches. However, two seats showed restraint openings greater than 6.5 inches, including the seat that Tire sat in, which was 7.19 inches tall.

Officials described the freefall ride as an “imminent serious public health hazard” in an order released to the public this month.

The order officially ended the ride on March 25, a day after the teenager fell to his death from the freestanding drop tower in front of horrified onlookers.

When it opened in December, the Free Fall’s nearly 430-foot drop was billed as the tallest in the world. The ride was inspected for the first time on December 20th. No defects were found and the ride passed its inspection, officials said. The ride was closed after Tire’s death.
