Michigan community eyes Supreme Court battle with anti-Semitic picket line

Eliott Sorkin

In the latest move in a long-simmering conflict between a synagogue in Ann Arbor, Michigan, and a group of protesters who have been striking their Shabbat services for nearly two decades, a parishioner is now asking the Supreme Court to intervene while recently confronting one Judgment that he and a joint plaintiff must pay more than $150,000 in court costs for the protesters, Jewish Insider’s Marc Rod reports.

Background: For the past 18 years, protesters belonging to a group calling themselves Witness for Peace (WFP) — formerly Jewish Witnesses for Peace and Friends — have displayed dozens of provocative signs on either side of the street in front of the Beth Israel Congregation every Saturday morning each week Parishioners come to the Shabbat service. Signs include messages such as “Resist Jewish Power” and “End Jewish Supremacy in Palestine.” The Anti-Defamation League has labeled WFP “anti-Semitic” and its leader, Henry Herskovitz, a Holocaust denier.

See you in court: In 2019, Beth Israel parishioner Marvin Gerber and Miriam Brysk — who attends another congregation that holds synagogue services — filed a lawsuit in federal district court against Herskovitz and his associates, arguing that the WFP violated their First Amendment right to freedom of movement to practice their religion. WFP, supported by the American Civil Liberties Union, says the protesters are exercising their constitutionally protected right to freedom of expression. So far, the community members’ arguments have not been successful as federal district and county courts oppose them.

Reinforcement: Gerber is now asking the Supreme Court to take up the case. He has until April 1 to submit a formal application. Nathan Lewin, who has argued before the Supreme Court nearly 30 times, recently agreed to represent Gerber pro bono. “The Jewish community in the United States should view [the lower court’s ruling] as a clear and present danger,” Lewin told JI. “Not just because it combines what [the lower court judge] considered simple anti-Israel propaganda with what is pure anti-Semitism. But I think the most important thing is that it really prevents, intimidates and harasses the people who go to the synagogue from the right to worship.”

IT IS THE LAW

Pay transparency will soon be mandatory in New York City

one

“Mandatory salary transparency in job descriptions is coming to New York City. With as many as 4,000 Jewish organizations, synagogues and schools in the New York metro area, this represents a significant culture shift for tens of thousands of employees,” writes Jessica Rothbart, advisory board member for the Gender Equity in Hiring Project, in an opinion piece for eJewishPhilanthropy.

Turning point: “Wage transparency has been taken seriously in the Jewish community since 2018. That’s when I joined the first cohort of gender equality advocates in the Gender Justice in Hiring Project in the summer of 2018. We cautiously discussed the ins and outs of why a pay range closes the gender pay gap and how to invest leadership in the dozen Jewish organizations represented at the table. With nine cohorts completed, many organizations have changed their practices. Salary transparency on job postings appeared in various forms – hourly rates, annual salary ranges, exact numbers – along with explanations of benefits that complemented an employee’s overall package. Change was underway, but the tipping point for all organizations will come [when the city’s mandate goes into effect] May 15, 2022.”

Small window remains: “The 108 organizations that have gone through the GEiHP program have started doing the work to ensure salary transparency is part of their culture. Fueled by research into how pay transparency narrows the gender pay gap and helps employees be happier in their role, 135 trainees returned to their organization to raise the bar in their hiring practices… That leaves many organizations – including a few the largest in our community – Respond to the upcoming law with a small window of opportunity to make the change. While transparency will be mandated, your organization still has time and updates you can make to prepare your people and improve your culture.”
