Medina – In the darkness on Thursday evening, a gray Ford F-150 pulled up in front of the house and the chorus of tears and joy began.

“Hello mom, hello mom!” was called out again and again as children ran to greet the truck.

Amidst a crowd of about 35 people, a pale, slender figure stepped out and was embraced by hugs and kisses.

It was Cindy George who was released from prison after 16 months. She had been sentenced to life imprisonment.

Summit County Common Pleas Judge Patricia Cosgrove, who is upholding her 2005 ruling that George plotted with his lover John Zaffino to kill her former lover Jeff Zack, was ordered by the Ohio Circuit 9th Circuit Court of Appeals to release George sentenced.

That court ruled 2 to 1 that the circumstantial evidence presented by the prosecution was insufficient to prove George’s guilt.

Five of their seven children – Alysiarose, Antoinette, Audrianna, Anthony and Annamaria – and many close friends and relatives were waiting outside the house. The other two daughters, Allivia and Angelica, drove her home.

Her husband Ed was in the background smiling tenderly as their daughter Angelica pulled the truck up to the front door at 9:31pm.

“Oh God. Oh, that’s great,” he said.

Cindy’s brother, Glenn Rohr, presented her with a pocket angel.

“Keep this forever,” he said.

The pocket angel belonged to her mother, who died in September.

George was wearing a blue tracksuit and sneakers. Her hands were over her mouth and she was crying.

Her husband hugged her. “You need to acclimatize,” he told her tenderly.

Inside, balloons covered the dining room ceiling. “Welcome Home Cynthia” was written on a cake.

The judgment of the Court of Appeals was issued on Wednesday. Cosgrove waited to release George until the appeals court on Thursday denied a request from prosecutors to stay the sentence pending a review request.

George, 52, has been at the Ohio Women’s Reformatory in Marysville for 16 months after Cosgrove sentenced her to life in prison without prospect of parole for 23 years.

Prosecutors had campaigned against her release, saying they viewed her as a flight risk. Cosgrove’s release order required George to turn in her passport and not leave the country until the Ohio Supreme Court rules on the state’s appeal. A condo owned by the Georges in Naples, Florida was posted for bail.

Prosecutors on Thursday petitioned the Ohio Supreme Court to stay the appeals court’s verdict. They will appeal to this court if the 9th Circuit Court denies their request for retrial.

While George cannot be tried again on the murder charge, her conviction could stand if prosecutors succeed in their appeal.

However, George’s attorney, Bradley Davis Barbin, doubts that will happen.

“There is an odd chance that the [Ohio] Supreme Court could overturn the circuit court of appeals. But if they overturn that decision, they’re going to face a problem in federal court: ‘They’ve all already said she’s innocent. She can’t undo the innocence,'” he said. “You can only be tried once. And once you are found innocent, you can never be tried again.”

George and Zack, 44, of Stow, had a 10-year relationship and a child that her husband Ed George believed was his. But when Cindy George tried to end their relationship in May 2001, Zack got angry and threatened to take their child.

Zack was fatally shot in the face on June 16, 2001 while sitting at a gas pump in his SUV. Witnesses saw a motorcycle and a rider, his face covered by a dark helmet, leave the scene.

Zaffino was arrested about a year later. He was found guilty of murder in 2003 and sentenced to life imprisonment. All appeals have failed. He maintains his innocence and never implicated George.

George’s relationship with Zaffino was discussed at his trial, where she refused to testify.

She was charged in January 2005 and waived a jury trial.

While Zaffino’s trial included witnesses and evidence connecting him to the murder, George’s trial focused on phone records, letters, and financial documents.

Cosgrove decided that much of the evidence, while circumstantial, was compelling.

George did not testify at her trial and had previously declined an amendment to plead guilty to conspiracy and face a maximum sentence of 13 years.

Court of Appeal judges William Baird and Beth Whitmore ruled that the circumstantial evidence Cosgrove had used to convict George did not prove that she had asked Zaffino to kill Zack.

No one overheard her phone calls, witnessed her private meetings, or could prove that she paid for the motorcycle so they could use it for the murder.

“It would be improper to infer guilt from the mere fact that George was romantically involved with the killer, or that she cheated on her husband in the process,” they wrote.

Zaffino had his own motive. “Maybe he wanted to be his mistress’ hero and take it upon himself to end her problem with Zack,” they wrote.

Judge Lynn Slaby disagreed, saying he believed the evidence was credible to convict George.

Earlier in the evening, as family and friends waited, daughter Alysiarose, 18, modeled her royal blue formal prom dress.

“The nice thing is that your mom will be here to help you get dressed,” said her aunt Bonnie Rohr, Glenn’s wife.

Alysiarose attends Our Lady of the Elms School in Akron. She was in a cooking class making pizza when the vice president called her into the office. Antoinette also called and the assistant principal told her that her mother had been released.

“I went crazy, I couldn’t believe it,” said Antoinette, 17.

Alysiarose went back to her cooking class and started crying. She said to her teacher, “My mother is coming home.” Her teacher hugged her tightly.

Anthony, 14, said he was at school “chilling out in science class”.

“I quit science class. I was happy about that,” he said. “It was a very good day.”

Cynthia first met her multimillionaire husband Ed George when she was auditioning for Akron’s Tangier nightclub to be a dancer, according to “Killer Couples” on Oxygen.

“I saw them kiss and sometimes he would come over at night and they would disappear somewhere,” Marianna Brewer, one of the Georges’ nannies, told NBC.

Zack scared the George kids, although they were never brave enough to talk about it.

“I just didn’t like it when he was around,” one of the daughters told NBC. “I just sensed a bad vibe from him.”
