On April 28th, the new A&E series Accused: Guilty or Innocent? returned with its second episode which explored the case of Danita Thetford Tutt, who was accused in 2016 of attempting to murder her son Colby Tutt. Prosecutors alleged that Tutt, a mother from Cleburne, Texas, injured her son through unnecessary surgery and then withheld food to starve him. In October 2018, a Tarrant County jury found Tutt guilty of one count of grievous bodily harm to her child and one count of attempted murder for depriving her child of nutrients and food. The jury deliberated for five days before returning its verdict. A few days later, on October 26, 2018, Tutt was sentenced to five years in prison for assaulting a child and a recommended 10-year suspended sentence for attempted murder.
At the time, one of Tutt’s defense attorneys, Terri Moore, said: “She’s devastated. There is no doubt about it. She is heartbroken. She’s flat on her face right now. She’s not someone who’s ever given much thought to spending time in the courthouse. Nobody knows the stress of being in court until it happens to them.” Moore added that the doctors taking care of Colby should take the blame for what happened because they convinced Tutt that her son was terminally ill and dying.
In a statement to Heavy, Moore said: “I still get sick thinking about Danita. She is an innocent young mother. The jury screwed it up,” she adds, adding that she believes the jury was influenced by media coverage of the case, which led to the trial that cast Tutt in a negative light.

However, hospice nurse Connie Koehler later discovered that Colton was not dying and was able to eat solid food and liquids – prompting her to report Danita.
Danita was accused at the time of being an “attention-seeker” who “enjoys the attention she gets because she has a medically vulnerable child.”
However, the mother was never officially diagnosed with Munchausen syndrome, a medical condition in which a caregiver triggers or causes an illness or injury in someone she cares for.

The operations included the placement of a central line, which later resulted in a life-threatening blood infection, police claimed at the time.
The mother was found to be refusing to feed and give water to Colby and had made arrangements for the funeral – even going so far as to buy him a coffin.
She was charged with three counts of causing aggravated assault on a child and attempted murder, but was found not guilty on the first two counts.
Fort Worth Police began the investigation after being contacted by CPS, who took Colby into emergency custody the same day.
The allegations against Danita were set out in an indictment read to the mother by her defense attorney Terri Moore (pictured) before her trial.
Reflecting on the case, Terri said, “What’s terrible is defending someone who you think is innocent.”
Hospice workers had reported to the agency that the night before, the mother had taken Colby from her care without the doctor’s permission – and with disregard for his health and well-being.

The mother, pictured at a fundraiser for her son, said the allegations were like someone stabbing her in the heart and that her child was her “whole world”.
Referring to allegations that she gave him unnecessary painkillers, she said: “I just wanted him not to feel the pain where he can enjoy himself and feel good.”
“That’s what she told me,” Danita snapped back, “Connie told me that eating and drinking makes him elongate. I didn’t know what it meant to prolong the inevitable until she told me.”
She then referred to allegations that she had previously made funeral arrangements for her son and asked for painkillers so he could “fall asleep and not wake up”.
“We would never have known what to do,” she insisted.
“I just wanted him not to feel the pain where he can enjoy himself and be comfortable.”
Reflecting on the case, Terri said: “In my view, Danita is absolutely innocent of these allegations. I’d much rather defend someone who is guilty, it doesn’t feel weird defending someone who is guilty.
“What’s terrible is defending someone you believe with every ounce of your being to be innocent.”

The Tarrant County jury on Friday also found 42-year-old Danita Tutt, of Cleburne, guilty of injuring a child. She was acquitted of two other counts of harming a child. According to the Fort Worth Star-Telegram, the assault charge carries a sentence of five years to life. The charge of attempted murder carries a prison sentence of two to 20 years. Prosecutors said Tutt lied to doctors about her son’s symptoms, which led to Colby Tutt, now 13, undergoing unnecessary gastrostomy surgery and other procedures. They also said she injured and almost killed Colby by depriving him of food and nutrients and even buying his coffin. “Mrs. Tutt is an attention-grabbing person and enjoys the attention she gets because she has two medically vulnerable children,” according to CPS documents seen by the newspaper. “There are concerns that she could end Colby’s life. There are concerns about his sibling’s safety.” Medical staff reportedly told CPS and police that Tutt asked if there was anything that could be given to her son “to put him to sleep” and not ” to wake up”. Tutt has argued her son suffered a brain hemorrhage at birth, which led to years of serious health problems. Defense attorneys claimed that the surgeries Colby underwent were necessary and that Tutt only bought a coffin after being pressured into it by a hospice company. “There is no question that he was ill,” said Christopher Cooke, Tutt’s attorney. “This lady literally dedicated her life to caring for this little boy and his medical problems,” Cooke said. “… In our opinion, the allegations against Ms Tutt are not true at all. Too many people were looking over her shoulder – doctors, family, friends. I literally have 25 affidavits sitting on my desk attesting to what an outstanding person she is.” Child Protection Services removed the boy and his younger brother from their home in 2016. When the guilty verdict was read, relatives and friends of Tutt’s family cried. “Now you have two little boys who are being separated from their mother. It’s so sad,” said Serena Bair, a family friend. “She’s as innocent as the day is long.” Bair said she’s worried about Tutt’s husband, Clint, who will take care of the kids. “She’s a good person, a good salt of the earth. Just like Clint. And these children are great, loving children. They didn’t deserve that. It’s wrong,” she said. The punishment phase of the trial is scheduled to begin on Monday.
