Candace Rae Jackson-Akiwumi (born 1979)[1] is an American attorney and judge serving as a United States Circuit Court of Appeals Judge of the United States Circuit for the Seventh Circuit as of July 2021. Previously, she was an attorney with the Federal Defender Program in the Northern District of Illinois from 2010 to 2020 and a partner at Zuckerman Spaeder in Washington, D.C. from 2020 to 2021.
Early life and education[edit]
Jackson-Akiwumi was born in Norfolk, Virginia, to US District Judge Raymond Alvin Jackson[2] and former Norfolk District Court Judge Gwendolyn Jackson.[3] Jackson-Akiwumi received her Bachelor of Arts with honors from Princeton University in 2000 and her Juris Doctor from Yale Law School in 2005.[4] At Yale she was senior editor of the Yale Law Journal.[5]

She began her legal career as a trainee lawyer with Judge David H. Coar of the United States District Court for the Northern District of Illinois from 2005 to 2006 and then with Judge Roger Gregory of the United States Court of Appeals for the Fourth Circuit from 2006 to 2007. From 2007 until 2010 she was a trial attorney for Skadden, Arps, Slate, Meagher & Flom in Chicago.
From 2010 to 2020 she served as a prosecutor with the Federal Defender Program in the Northern District of Illinois.[6] In 2018, she was also an Associate Lecturer in Criminal Law at Northwestern University’s Pritzker School of Law.[1] From 2020-2021, she was a partner at Zuckerman Spaeder in Washington, D.C., where she focused on complex civil litigation, white collar crime defense and investigations.[4]

On March 30, 2021, President Joe Biden announced his intention to appoint Jackson-Akiwumi as a US District Judge for the United States Court of Appeals for the Seventh Circuit.[4] On April 19, 2021, her nomination was submitted to the Senate. President Biden nominated Jackson-Akiwumi for the seat vacated by Judge Joel Flaum, who assumed senior status on November 30, 2020.[7] On April 28, 2021, the Senate Judiciary Committee held a hearing on her nomination.[8] On May 20, 2021, her nomination was reported by a vote of 12 to 10 from the committee. On June 23, 2021, the Senate invoked Cloture by a vote of 53-47.[10] On June 24, 2021, her nomination was confirmed by a vote of 53–40.[11] She received her appointment as a judge on July 1, 2021.[12] She is the second African American (after Ann Claire Williams)[13] and the first former federal public defender[14] to sit in the Seventh Circuit.

The work of a federal defender
As of July 1, 2021, Candace Jackson-Akiwumi has served as a US District Judge for the US Circuit Court of Appeals for the Seventh Circuit.
I’ve been a staff attorney with the Federal Defender Program, Inc. in the Northern District of Illinois since 2010. I represent destitute people from across northern Illinois accused of federal crimes. I represent my clients in U.S. District Court, U.S. Court of Appeals for the Seventh Circuit, and enforcement order applications in the U.S. supreme court
Our office is the oldest federal defense office in the country. When the federal defense attorney system was created in the 1960s, each federal district court had the option of a.) establishing a federal office of public defenders staffed by federal employees and headed by a federal attorney appointed by the district appeals court, or b.) establishing a “community defense attorney ‘ organization which is a government funded non-profit organization with a board of directors that elects an executive director. In our district, the court chose option “B”. As a civil defense organization, our office does the same work as a federal office for public defenders; we are just governed differently. Accordingly, our office is the Federal Defender Program, Inc., our Executive Director’s title is “Federal Defender” (not “Federal” “Public” Defender) for the Northern District of Illinois, and I am an Associate Attorney (not ” Assistant Federal Defender).
I represent clients in all types of cases. About a third of my cases are fraud – from bank fraud to bankruptcy fraud, credit card fraud, identity theft, wire fraud, mail fraud, social security fraud, theft of government funds and more. Another third of my cases are guns and drugs: clients charged with the sale or possession of guns, the sale or attempted sale of narcotics, and related cases. A final third of my cases are just a big mix ranging from bank robberies to immigration crimes to child pornography and other sex crimes. My office assigns cases in a highly egalitarian manner, which contributes to my job satisfaction: All cases that come in on my monthly “duty day” — whether it’s the largest terrorism case or a minor case of supervised dismissal violation — go to my cases. My average case takes about a year to convict. I juggle around 30-50 cases at a time, all at different stages and with varying levels of complexity and time commitment.
I represent clients at all stages of their cases. I take your case from arrest (or the moment the US Attorney’s Office notifies a client that he or she is under investigation) through trial or a guilty plea to conviction. If a customer wants to appeal, I process the appeal. If a client wishes to appeal again to the Supreme Court, I work on that request for a hearing as well.
Criminal law is more diverse than I imagined when I started my job, and being able to conduct both trials and appeals is incredibly rewarding. The variety doesn’t end here. I’m also a negotiator: Since more than 95% of defendants choose to plead guilty, I negotiate plea deals all the time. I am a consultant and I help clients to make difficult decisions. I’m a strategist trying to find the smartest way to run a case and achieve the best possible solution for my client. I am an investigator: I hunt facts and evidence while we prepare for hearings, trials or convictions. I am a teacher who introduces clients and their families to the federal court system, which is very different from the state court system you may be familiar with. I am a lay social worker: many of our clients have disadvantaged backgrounds, extensive mental health histories, substance abuse issues and other everyday challenges. We work with harm reduction specialists and social work masters students in our office to thoroughly investigate our clients’ backgrounds, present the sentencing judge with an effective harm reduction case, and help our clients obtain the resources they need. (This is another type of variety my job offers: I work not only with clients, investigators, and specialists in our office, but also with probation officers, investigators, prosecutors, expert witnesses, families of clients, juries, and judges. I am constant interaction with different people.) My job is rewarding because I have to fill all these roles in different places. My job is exhausting because I have to fill all these roles! I work harder and longer than I worked as an associate. But I don’t mind the harder work, longer hours and lower pay because my job means something to me. I provide quality representation for people who cannot afford it, and I am there for clients in what is an extremely desolate and frightening moment: when they are being judged for the worst day or days of their lives.
Listening and communication skills, flexibility, good instincts and compassion are valuable for defenders. Additionally, oral and written defense skills are even more important than technical negotiation and appeal skills. Only a fraction of cases go to court or are challenged, and the government wins more than 90% of the few cases that do go to court. This means that almost all of my cases end up at a sentencing hearing, where a solid oral and written defense is paramount to persuading a judge to issue a fair and reasonable sentence. One must also have thick skin and a penchant for moving forward in the face of seemingly insurmountable odds: winning must mean saving unnecessary years and months of a client’s sentence, helping the judge formulate a verdict that respects a client’s could bring help he or she needs, or negotiate a smarter plea deal. We don’t often win trials and contested hearings, but we must keep trying. There are numerous examples of the Defense Chamber fighting an issue over and over again and losing all the time, only to eventually weigh the Supreme Court or Congress and right a wrong that the Defense Chamber has been fighting for years.
During law school, I knew I would be working in the public interest, but I never considered criminal defense. After graduating, I was a clerk for a federal district court judge and then for a federal circuit court judge. I then worked as a litigation associate in a large law firm for three years. When I first started applying for public interest positions, I loved hearing former federal defenders talk about their jobs. The job seemed to have many of the elements I was looking for, including the opportunity to protect rights, fight for those in need, and enjoy variety. I now have the dream job that I didn’t even know was my dream job.
