The majority of women in prison are victims of domestic violence and Mindy is no exception to this rule. She was subjected to her stepfather’s violent and abusive actions for many years. For most of her life, Mindy was subjected to verbal and physical abuse. James Smallwood, Henry Dodd’s nephew and a victim of his abuse, shot and killed the abused man. From what Mindy explained to the parole board:

James Smallwood threatened to kill Henry Dodd, but I didn’t take it seriously when he said he would. Even when James Smallwood found Henry Dodd’s gun, I still didn’t think it was going to happen. I can honestly say that I should have reported James’ plans to someone in authority instead of standing by and watching a guy get murdered.”

Child rape survivor awaits governor’s parole decision for murder of stepfather-husband

SMYRNA, Tenn. (WKRN) — Mindy Dodd was sentenced to life in Smyrna 20 years ago for the murder of her stepfather and late husband, but advocacy groups are urging Gov. Bill Lee to give her a second chance at life.

“Mindy Dodd is a child rape survivor who is currently serving a life sentence in Tennessee for the murder of her stepfather-husband,” said Heather Meshell, an attorney with the Nashville Love and Justice Project who is campaigning for Dodd’s release from prison.

Dodd was just eight years old when her stepfather, Sherman Dodd, began having sexual intercourse with her. It lasted 10 years and when she became pregnant at 18, he divorced and married her mother.

“They had a second child. She lived a life of ongoing abuse and coercion, with her husband and stepfather controlling her every move and threatening her and her family’s life,” Meshell explained.

In December 1999, Sherman Dodd’s nephew James Smallwood, who had also been sexually abused by his uncle, shot and killed him near their home in Smyrna. Smallwood told police it was his and Mindy Dodd’s idea and that she provided the gun.

Meshell said Dodd knew Smallwood wanted to kill her husband, but said she didn’t think he meant it. Both she and Smallwood were sentenced to life imprisonment.

“Mindy maintains her innocence, she expresses regret that she did not step in and prevent the nephew from killing her stepfather husband,” Meshell exclaimed.

Jim Todd served as both a prosecutor and criminal defense attorney in Tennessee for two decades. News 2 asked him to comment on the case.

“The problem with the criminal justice system is that almost everyone in it comes from a horrible background and most likely has some kind of aftermath from it that causes or enables them to commit these crimes,” Todd explained. “You know, unfortunately the system isn’t sufficiently designed to take all of that into account.”

On January 30, 2020, the Tennessee Board of Parole made a unanimous recommendation to Gov. Bill Lee to grant Dodd eligibility for immediate parole. But more than a year later and 20 years after her sentence, the recommendation is still on his desk.

Lee’s office told News 2 in a statement, “Currently, the governor is reviewing the case under established procedure.”

This was just days before Lee declared April as Second Chance Awareness Month as part of his criminal justice reform.

“Your case is a perfect … intersection of Sexual Assault Awareness Month and Second Chance Month,” Meshell said. “We’re talking about a children’s rights survivor who was raped at the age of eight and it’s not really a second chance, we’re asking the governor to give her the first chance at a life free from her abuser, from her rapist, from her.” Bully, she never really had the first chance.”

The Love and Justice Project started a petition to Gov. Bill Lee to grant Dodd parole.
