The allegations against Clinesmith surfaced last year when Justice Department Inspector General Michael Horowitz referred to them in a report detailing the flaws in how the bureau sought under the Foreign Intelligence Surveillance Act, former Trump campaign adviser Carter Page as suspected foreign agents to monitor.
Page had a previous relationship with the CIA, a fact that may disprove the notion that he was a foreign agent. In court documents filed Wednesday as part of Clinesmith’s pleading, prosecutors wrote that in August 2016, the CIA gave certain FBI investigators assigned to the Russia case a memo that said Page dated 2008 was approved as an “operational contact” until 2013 and that he disclosed his contacts with Russian intelligence officers.

That memo, prosecutors wrote, was available to the agents in the case and to Clinesmith “upon request.”
However, the FBI did not reveal Page’s CIA connection when it requested surveillance over the following months. It wasn’t until Page began speaking publicly about the matter that an FBI agent preparing the request for an extension of surveillance asked Clinesmith to clarify Page’s connection with the agency, according to court documents.
According to the documents, Clinesmith knew that if Page were a CIA source, it would have to be disclosed to the Foreign Intelligence Surveillance Court. He told inspector general investigators it could “drastically change” the way the application was processed, according to the documents.
But in messages with the FBI agent, Clinesmith said Page was a “sub-source” but “never a source,” according to the documents. When the agent asked for written documentation, Clinesmith forwarded an email from a CIA liaison that indicated some type of relationship but included the phrase “rather than ‘source'” in the text. The agent then did not disclose Page’s relationship with the CIA in the surveillance application.

Boasberg, who is leading the Clinesmith case, has been a member of the secret oversight tribunal since 2014. After Horwitz’s report, the judge ordered the FBI and Justice Department to issue an evaluation of the errors found by the Inspector General and determine whether those omissions or misstatements were intended to invalidate certain surveillance requests granted by the court. At the beginning of Wednesday’s hearing, Boasberg acknowledged his role in the secret court, noting: “Although I did not sign any of the four motions at issue, I could see that the [supervision court] could itself be viewed as a victim.” of false statements. Specifically, Durham investigators have questioned how the FBI handled the case after it questioned the credibility of Christopher Steele, a former British intelligence officer whose work the FBI relied in part on to the secret court order monitoring Pages have said to get acquainted with the matter. In a bipartisan report released Wednesday, the Senate Intelligence Committee was particularly harsh on Steele and how the office used his reports, which claimed that Russia and Trump’s 2016 campaign were coordinated.
Although Steele’s sources were sometimes several steps away from the information they provided, and many of his allegations remain uncorroborated to this day, his material “was lent a veneer of credibility by lax procedures and layered misunderstandings,” the committee wrote.

Barr said Durham’s first priority is investigating and prosecuting criminal cases, although he will also likely prepare a report detailing his findings.
