But for investigating the Washington Football Team’s chronic atmosphere of workplace misconduct, the NFL would not investigate Raiders coach Jon Gruden over an email to former Washington CEO Bruce Allen. Now that the NFL has described the content of the email as “denigrating, appalling, abhorrent and contrary to our values of respect and inclusivity,” the NFL must decide what to do about it.
The Personal Conduct Policy becomes the first place to look for possible grounds for disciplinary action. Nothing in the current policy directly addresses the use of racist language in a communication with a third party, even if a violation 10 years ago would result in disciplinary action.
However, the policy has broad scope and prohibits “conduct that undermines or threatens the integrity of the NFL, NFL clubs, or NFL personnel.” It would be easy for the league to argue that Gruden’s comments fall under that standard.
Gruden would likely claim, if disciplined by that standard, that it was a private comment and not a public statement. The league probably wouldn’t care.
The stronger argument against any kind of discipline under the Personal Conduct Policy stems from the fact that Gruden made the comment when he was not employed by any NFL team. The league could then seek to claim that Gruden said what he said while working for an NFL broadcast partner and that the policy’s definition of “dismissal” brings those remarks within its scope.
“Workplace Environment means any location or transportation used in connection with NFL activities, including the club facility, training camp, stadium, locker room, location of a club-sponsored event and during travel with the Team or NFL-related business,” the policy explains. While it would be a bit of a stretch, Gruden, in his role as a high-profile employee of an NFL broadcast partner, sending emails to a high-profile executive with an NFL team could qualify as behavior in a “work environment.”
Ultimately, Gruden’s arguments and defenses may not matter. Just ask Saints coach Sean Payton about it; He was suspended for the whole of 2012 based on flimsy evidence and no meaningful basis to fight it. Coaches do not have a union and their rights, if any, flow through the league. If the league decides to take action against a coach, it will, as a matter of principle, do so – and the coach won’t have many viable options to act on. Unless Gruden turns his back on former Raiders owner Al Davis and sues the league, Gruden could have a hard time defeating any discipline the league imposes, even if the personal conduct policy doesn’t justify it.
The Raiders would have a hard time taking any significant action against Gruden, up to and including a good cause dismissal and stripping him of his right to any remaining guaranteed pay. Unless he signed papers when he was hired in 2018 promising he had no past wrongdoing that the team is unaware of and if the papers also reserved the right to remove him from important Ground to be dismissed, if such behavior later comes to light, the Raiders will be stuck.
On the other hand, any discipline imposed by the team would no doubt be subject to the dispute settlement procedures in almost every coaching contract. This condition requires that the trainer asserts any right or remedy through a complaints procedure, which will be resolved by the officer.
While it appears on the surface that league and team options are limited, the lack of a union for coaches and the existence of contracts and policies that stack the deck in favor of the league and team will make Gruden difficult to avoid any punishments to thwart the NFL or the Raiders might impose.
