HELENE, Mont. (AP) — A Montana man sentenced to 20 years probation after failing to plead involuntary manslaughter in the shooting of a neighbor is seeking early release from state oversight.

Prosecutors are dismissing the Oct. 4 motion filed by Joseph Campbell, 73, who shot and killed Timothy Newman in October 2013 in a feud over access to land.

Campbell was charged with first degree manslaughter, but a jury was unable to reach a verdict. Campbell then acceded to the plea agreement.

“It seems inconceivable that the defendant could take the life of a man and serve less than three years of probation and possibly be released from custody,” Assistant Attorney General Mary Cochenour wrote in the state’s response to Campbell’s request.

A district judge in Helena did not rule on the application, according to the Great Falls Tribune.

Campbell’s motion argues that a 2017 law allows offenders to apply for early release from parole if they meet the conditions of their eventual release date.

Prosecutors argue the law was enacted after Campbell’s conviction in May 2016. They say Campbell’s parole officer did not recommend his early release.

The segment, titled “Deadly Trespass,” is part of HLN’s original series, Vengeance: Killer Neighbors.

Zander Blewett, an attorney for the Great Falls law firm of Hoyt and Blewett, was one of many people interviewed by the show’s producers in the Campbell case.
