COLUMBUS, Ohio (AP) — Several people convicted in a scheme perpetrated by a former Ohio State and NFL quarterback and his accomplice should receive money from the former player’s share of a national concussion settlement, argues an Ohio prosecutor.

It’s about the case of former star player Art Schlichter, who is now serving a nearly 11-year prison sentence on federal fraud allegations.

Prosecutors say Arbitrator promised college and NFL game tickets, including for the Super Bowl, but never delivered, despite receiving thousands of dollars in payments.

One of Schlichter’s victims was retiree Anita Barney, the widow of one of Wendy’s former CEOs, who lost almost all of her life savings to Schlichter. However, Barney also deceived several friends and acquaintances under Schlichter’s direction and eventually pleaded guilty to two counts of theft for her involvement in the scheme, narrowly avoiding jail time. She was ordered to pay $427,000 to 19 victims.

Schlichter has received nearly $700,000 from a national settlement with the NFL over player concussions, according to a federal court filing filed by Franklin County Prosecutor Ron O’Brien last week.

Barney, as one of Schlichter’s victims, is entitled to about $177,000 of that, the filing says. However, O’Brien says the money should go to Barney’s 19 victims.

O’Brien asked a judge on June 16 to turn over the money, currently being held by a federal court official, to the state, which will allow the money to be distributed to victims. This is the “only remedy available to the State of Ohio and the victims of Ms. Barney to obtain justice,” O’Brien said.

A phone message and an email message were left with Barney’s attorney for comment.

Meanwhile, a defense attorney is again asking for the 60-year-old arbitrator’s early release, this time because of the dangers the coronavirus poses to prison inmates.

“While there is still much to learn about the virus, it is common knowledge that those in the defendant’s age group are at significantly higher risk of death if infected,” defense attorney Stephen Palmer wrote in a filing filed in March. “This is especially true if you already have previous illnesses.”

Schlichter suffers from multiple health conditions, including diabetes, high blood pressure and dementia, Palmer said.

O’Brien’s office opposes the move, noting that Schlichter was convicted of gambling by prison authorities only three months ago. Schlichter is currently being held in a federal prison in Florence, Colorado.

“Schlichter has not changed during his incarceration and to the extent that he is granted early release, he will be gambling and stealing earlier than the 10 years agreed upon at his sentencing,” O’Brien said in an April filing .

Schlichter played for Ohio State between 1978 and 1981 and later for the Baltimore and Indianapolis Colts and Buffalo Bills, as well as for the Detroit and Cincinnati Arena League teams.
